Terms and conditions regarding the use of the website www.safefleet.ro
1. Operator Identification Data

The website www.safefleet.ro (“Website”) is operated by SC ETA Automatizari Industriale SRL, headquartered in Timișoara, 11 Gheorghe Doja Street, VAT no. RO6825562, Trade Register no. J35/3680/1994 (“Operator”), a Romanian legal entity incorporated and operating in accordance with Romanian law.

This document, together with the General Terms of Business, sets out the legal conditions under which the GPS-based fleet monitoring and management services provided by the Operator may be accessed. By accessing and using the website, as well as the materials and information made available through this platform, clients confirm that they unconditionally accept the terms and conditions set out in this document.

2. Applicable Legal Framework

The services offered through the Website are provided in accordance with:

• Regulation (EU) 2016/679 (GDPR)
• Directive 2002/58/EC
• Law no. 365/2002
• Law no. 506/2004
• The Civil Code
• Any other legal provisions applicable to electronic communications and data protection

3. Scope of Services

The Operator provides services such as:

• GPS vehicle monitoring
• Real-time location tracking
• Route, consumption and stop reports
• Driving behavior analysis
• Fleet management through a secure online platform

The services are intended for legal entities and authorized sole traders using vehicles for professional purposes.

4. Nature of the Processed Data

In the context of providing fleet management services, the following categories of data may be processed:

• Client identification data (representatives, contact details)
• Vehicle data (registration number, chassis number)
• Location data (GPS coordinates, routes, parking duration)
• Technical data regarding vehicle use
• Platform user data

Location data associated with an identified or identifiable driver may constitute personal data within the meaning of Regulation (EU) 2016/679.

5. The Role of the Parties in Data Protection

Depending on the nature of the contractual relationship:

• The Client (employer/fleet owner) acts as data controller with regard to employee monitoring
• ETA AUTOMATIZĂRI INDUSTRIALE S.R.L. may act as a processor, processing data exclusively on the basis of the Client’s documented instructions

6. Client Obligations

The Client undertakes to:

• Transparently inform drivers about GPS monitoring
• Establish a valid legal basis for data processing (legitimate interest, legal obligation, etc.)
• Respect the principles of proportionality and data minimization
• Not use the system for unlawful or abusive purposes

Continuous monitoring outside working hours must be justified and proportionately limited.

7. Data Security

The Operator implements appropriate technical and organizational measures, including:

• Encrypted communications
• Secure platform authentication
• Tiered access control
• Access logging
• Regular data backups

Data is stored on servers located within the European Union or in countries ensuring an adequate level of protection.

8. Limitation of Liability

The Operator shall not be liable for:

• Improper use of data by the Client
• Managerial decisions made solely on the basis of automatically generated data
• Temporary unavailability caused by external factors (GSM networks, satellite services, force majeure)

9. Data Subject Rights

Data subjects benefit from the rights provided by Regulation (EU) 2016/679. Requests concerning data collected through the GPS system shall primarily be addressed to the Client acting as data controller.

10. Intellectual Property

The software platform, applications, algorithms, interface, technical documentation, content and graphic elements, source code, trademarks, service marks and logos, including but not limited to these, all text content, graphics, as well as the technical foundations of all present and future services and features are subject to copyright and represent the exclusive property of ETA AUTOMATIZĂRI INDUSTRIALE S.R.L., being protected by copyright legislation.

11. Governing Law and Dispute Resolution

Romanian law shall govern both the performance of the obligations arising from this document and any matter relating to its interpretation, application and/or scope of effects.

Any dispute relating to the performance of the Agreement shall be settled amicably. If such settlement is not possible, the dispute shall be submitted to the competent courts.

12. Final Provisions

The Operator reserves the right to update this document whenever necessary to comply with legislative or technological changes. The version in force is the one published on the Website on the date of access.
